The term Civil Dispute indicates any disagreement between two or more individuals or organizations that is distinguished from criminal disputes by a lack of involvement of law enforcement agencies and does not require the involvement of the state as a principle party in the dispute. Civil Disputes generally involve tort, contract, or probate laws and are resolved by the court with the awarding of compensation, usually in the form of financial damages.

Inheritance/Estate Disputes challenging and defending Wills and those receiving benefits through inheritance. Often elderly parents will put a child’s name on a bank account or investment account without intending that the child retain those funds on death but merely to make them available to the parent should the parent become unable to access them due to illness. This often leads to conflict upon the parents death. Proving that the transfer was merely for “the convenience of the parent” while alive, returns those funds to the estate, and to their fair distribution.

Massachusetts has some of the strongest laws in the country designed to protect employees. Recently our office successfully represented an Employee who had not been paid commissions owed to him. The Employer ended up paying twice the amount owed plus our firms fees and costs for wrongfully withholding those commissions.

Contractor/Mechanic Lien Disputes; Homeowners on the South Shore hired a contractor to build an addition to their home. The Contractor didn’t pay his subcontractors and didn’t finish the addition. The subcontractors put mechanics liens on the client’s home, preventing them from remortgaging the property, so that they could complete the job. Mechanics liens have very specific rules that need to be followed. Our office was able to have the liens removed and the homeowners were able to finish their project
